The lesson I take from that would be, in a similar situation, call the cops, report the burglary next door, tell them you're checking your own house; hang up (no matter what the dispatcher says); go outside; and shoot the batards.

I see nothing wrong with what he did, but his "I'm gonna kill'em" comment wont help his defense team.

I would never go on about how I need to shoot the bad guys rather than let them go, no matter how much I felt that way. Do - don't say.

Yes, but (1) some prosecutors do; (2) the dispatcher (and the recording) isn't dead; and (3) he only shot one of the two guys.

Also the entire event is on the cell phone and there is no evidence that he confronted them at all. This is just the kind of event, those that want to take more civil rights from us need to make their case.

It seems like he really wanted the cops to get there and stop it, and when they didn't, he didn't want those scum to get away. But he was stupid for saying (not for thinking) all that stuff on the record. He could have kept his views quiet; hung up; shot the bastards; and had a much easier defense. Without forcing the dispatcher to tell him multiple times not to go outside and shoot the crims, he could have hung up and done it, and said he thought he was checking things out, and they threatened him in his yeard or something. Now, he can't avoid the conclusion that he just wanted to shoot the bastards. I would too, but wouldn't say it on the record just before doing it.

Protest Outside home of Joe Horn, the man who shot two men he saw burglarizing a neighbor's home.


HOUSTON -- A protest over a Pasadena man who fatally shot two men he believed to be burglarizing a neighbor's home turned into chaos Sunday.

Quanell X, along with relatives of the two victims, protested Sunday afternoon outside of the home of Joe Horn, the 61-year-old man who opened fire on the two men he believed were burglarizing a neighbor's home.

The burglary suspects -- Miguel Antonio DeJesus, 38, and Diego Ortiz, 30 -- were killed in the shooting, which happened about 2 p.m. on Nov. 14 at a home in the 15600 block of Timberline Drive in Pasadena.

Hundreds of people with signs of support for Horn lined Timberline Street Sunday afternoon waiting for the arrival of Quanell X, who organized a demonstration outside of Horn's home for 3 p.m. Sunday.

"He was perfectly within his rights to protect himself and his neighbor, and it's just wrong what Quanell's trying to start," Horn supporter Richard Flores said.

Quanell X believes Horn should be charged in the shootings.

"We're not out here because of race. We're out here because a man took the law into his own hands ... became judge, jury and executioner. That's what we're up against," Quanell X said. "(Horn) gunned those men down in cold-blooded murder."

Family and friends of the victims said all they want is justice.

"We know (DeJesus and Ortiz) were doing wrong. They deserve to go to jail, but don't deserve to be shot down here with no questions asked and nothing to defend themselves. Everybody has the right to go to the justice system. (Horn) was nobody to take that away from them," Stephanie Storey, one of the victim's girlfriend said.

Horn was on the phone with 911 operators when he opened fire on DeJesus and Ortiz with a 12-gauge shotgun. He confronted the suspects as they were leaving the home through a gate leading to the front yard. Both of the men were pronounced dead at the scene.



Horn said the shooting "weigh(s) heavily" on him, but the tape of his call to 911 reveals his determination to stop the men he saw leaving a neighbor's house against the dispatcher's clear warnings to stay inside.

Horn called 911 first, and told a police dispatcher that he planned to kill the two men -- just moments before he opened fire.

"I'm not going to let them go. I'm not going to let them get away with this," Joe Horn tells the dispatcher.

During the 911 call, which runs about six minutes, the dispatcher repeatedly tells Horn not to go outside or use his shotgun.

After Horn spotted the men coming out of the neighbor's house, he tells the dispatcher: "I ain't going to let them get away with this. They stole something. They got a bag. I'm doing this."

"Don't go out the house," the dispatcher cautions. "Don't be shooting nobody."

A few moments later, the click of a shotgun can be heard, then a warning barked by Horn: "Move. You're dead."

Three shotgun blasts follow.

After shooting the suspects, Horn again called police:

"Get the law over here quick. I had no choice," a frantic-sounding Horn says. "They came in the front yard with me. I had no choice."



Under state law, Texans are allowed to defend themselves with deadly force to protect their own property. The person using deadly force must believe there is no other way to protect their belongings.

However, it is unclear whether that law extends to using deadly force to protect a neighbor's property.

Horn, in a written statement issued by his lawyers on Nov. 16, also expressed sympathy for the families of DeJesus and Ortiz.

"Any loss of life casts permanent devastation over the lives of everyone involved," Horn said. "The events of that day will weigh heavily on me for the rest of my life. My thoughts go out to the loved ones of the deceased."

The Harris County District Attorney's Office is investigating the case but has not yet decided if the case should be sent to a grand jury.

I think the only thing he's got going for him is that this was in texas. :fdance:

I can understand when people protest a guy being shot to blazes by cops when they pull out a wallet (NY) or are ambushed in a car outside a bar (NY), but when they stand up for two guys blatantly caught in the act of a crime its just ridiculous. Are we supposed to respect peoples need to steal now? :raar:

HOUSTON -- A preliminary autopsy report shows that the two victims police believe to have been burglarizing a home in Pasadena last month may have been shot in the back.

Police had originally thought the wounds on the front side of Miguel Antonio DeJesus, 38, and 30-year-old Diego Ortiz's bodies were where the gunshots entered their bodies. But the report shows that the wounds in front side of their bodies actually are where the shots may have exited.

Ortiz and DeJesus died Nov. 14 by 61-year-old Joe Horn who shot them in the chest and lower abdomen area.

Horn said he saw the two men breaking into a neighbor's house and called 9-1-1 threatening to kill the men, a 9-1-1 tape revealed. As the men were leaving, Horn confronted and shot them with a 12-gauge shotgun despite an emergency dispatcher's instructions to stay inside his home.

I thought they were mexicans. Weird for both to be black with hispanic names. Probably from Puerto Rico or something. It is a shame the shooter changed his own life over this forever. In one hand, I would have taking pics. But in Houston, I am sure they are sick of crime in their neighborhoods and feel like if something is going to get done, they better help. (Pasadena is a suburb of Houston 20 mins from the Astrodome and Reliant). I would liketo say at worst I would have kneecapped them and waited for police. Then you have to always look over your shoulder when they get out and fear for your life. That is nice about Texas. Someone can be stealing from your car in town and it might be the last time they crap their pants. :giggling: Texas is strong on property rights. And the Death penalty as long as this stupid bull crap about lethal injections being inhumane gets worked out. (What kind of crap is that?) I say every murderer should die in the manner that they killed someone. But you say, who would want the job of carrying out the execution in that manner? I say other death row/Life sentence criminals would line up for the job. You don't think and Arian would want to kill another balck and a black would not want to kill a whitey or Hispanio? Screw all those bastards.
