I wonder if GM's woes affected their income stream at SMA.

Let's look at it from this view. Dana files Chapter 11. Delphi is hurting. Visteon is hurting. All of the downstream suppliers are getting hosed by the automakers.

Of course, GM would pay Delphi way before they would pay SMA. So SMA's stuck holding the bag for mounting debt while GM's making money on vehicles that contain the very tire carrier that SMA is making.

Looking into the crystal ball further - let's say (for fantasy's sake) that SMA had the exclusive contract for H2 and H3 accessories, and no one else did. If GM has enough parts inventory for about 6 months, what will they do from there?

Especially since SMA holds the patent on the H2's tire carrier and most of their variants. Anyone buying the rights to the tire carrier needs to (IIRC) assume the majority of debt as well.

So - GM may very well have screwed their own selves by shafting their downstream providers. People will only work on a debt basis for so long until they force GM to pay cash on the barrel head up front. And GM won't be able to shaft too many people much more....

I know a couple of people that deal with SMA from a manufacturing side and they are sueing SMA for non payment. They have a very bad reputation and it would not surprise me if GM is pulling the plug on SMA. Here is a letter from SMA attorney saying they filed Chapter 7.

SMA is NO Longer......

Dear Counsel,

Less than 10 minutes ago, I learned that KM2 Limited; SMA-Billet, LLC and SMA-Patents, LLC all filed voluntary Chapter 7 Bankruptcy petitions in the District of Arizona. Our firm has not been, and will not be, bankruptcy counsel for these entities. I believe they are represented by Mike Reynolds at Collins, May, Potenza, Baran & Gillespie.

I have not seen official notifications from the Bankruptcy Court on these filings, and trust that they will be sent to you and/or your clients in ordinary course. I have confirmed the filings on the internet, however.

I am sending this information to you as a courtesy “heads up” so that you are aware of the filings in determining how to proceed on behalf of your respective clients.

Then they got competition and GM licensed with a bunch of other people for different accessories.

I also doubt they would be filing chapter 7 if GM was very delinquint on payments to them. If there was a contract, and services provided, it really doesn't matter what GM's financial woes were. SMA would have filed to restructure their debt or something, not just shut everything down and go under because they would have been paid.
