Default What do you think should happen

A good friend of mine took his vehicle into the local dealer to have some work done on it. Once the dealers shop completed the work their tech took the truck out for a test drive to make sure everything was done right. During this test drive another driver slammed into the rear of the truck, bent the frame and totaled the truck. The dealer put him in a rental for the time being and now the fun should begin. The truck in question was a 99 Explorer in excellet condition and it was a Ford dealer that had poession of the truck when the accident occured. What would you ask for from the dealer to try and make the problem seem fair to all sides?

How about what got wrecked? A 99 Ford Explorer or something similar in excellent condition. Its not like the service tech was at fault in the accident. I would go after more if it was the dealer at fault. But since it was the other guy, go for what was lost.

Are we talking rental car or replacement?

The driver at fault should have insurance and maybe the tech did as well. I would see how that all pans out.

I would think that the dealership would prolly compensate with a rental and maybe some free oil changes or allow purchase at cost on a new vehicle from insurance money. That would be nice.

He is hoping for a smokin' deal on an 06' closeout. He hasn't heard from the dealer itself as of yet just the insurance company (not sure who's insurance company thought). I told him to talk to the sales manager or owner if he can and see what they will be willing to do for him.

The dealership will take care of it(thier lawyers will advise them too)....He should probably contact them and throw the 06 deal out on the table, etc. Not just sit around and wait for them to contact him or make an offer.

Your friend is only entitled to replacement of the vehicle. About $8600, retail, if loaded and in excellent condition. I wouldn't expect him to get that much money.

Since it was determined it was the other driver's fault, then the dealer owes him nothing. However, if the dealer volunteers anything, then it would be a gift and your friend should be very thankful.

I had a similar situation when a car was stolen, my insurance covered the replacement. Dealer had done all he could with a chain and locked fence to store the vehicle in.
