Default Our little accident

We had an accident a little while ago. We were headed to the dentist and a guy on a bicycle went through traffic and ran into the side of our truck. We were in the turning lane. So, the cops came and the ambulance took him to the hospital. He had road rash and his bike is toast. What sucks is the cops are saying it's our fault because we were in the turning lane too soon and the insurance co. is saying it's his fault for hitting us by not being at a crosswalk and going in between vehicles. I think it's his fault. Hopefully he's okay though. I don't want nothing to happen to him obviously, I just don't think we should foot the hospital bill or be sued when he ran into us. Geico is investigating it further but says we weren't at fault. Here's a picture of our minimal damage.

In Ohio pedestrians and those on pedal bikes have the right of way no matter what. Hence a runner or a biker can run right smak into the side of your car and its your fault. Its BS, but its the law.

On another note, I heard someone (out west) just got a ticket for driving a horse, while intoxicated! Talk about stupid laws.

I talked to the adjuster about the accident and if he sues us the insurance would pay for it IF they release us from any further obligation. this is if he gets a lawyer and had serious injuries, which hasn't happened so far and I know he didn't have serious injuries since I talked to him last night. however, as far as his hospital bill, if anyone in his house or him owns a vehicle we don't have to pay his hospital via our insurance. if not, we have the coverage to pay his hospital bill because we have bodily injury coverage.
they are thus far showing him at fault since even though the police said we were, insurance doesn't go by the criminal courts as far as payouts.
so it looks like we're in the clear, which is great news. I found out that even if he did sue us we're covered. (that's the bottom line I may have repeated up top)
Rich already fixed our truck.

Too bad the hospital he went to didn't have an angel of death on staff.

HTF did he miss seeing the big yellow barn coming at him? His fault for not paying attention.

in florida bicycles are considered motor vehicles so if he ran into the side of the hummer , I would think he would have a hard time proving its your fault. Cops are not the end all authority in accidents, thats why there are courts and "specialists". I think as long as you have Geico standing up for you it should be okay. My wife had some one merge into her and claimed she tried to run her off the road and after going to court we had it all resolved with no out of pocket expenses (insurance took care of it).
Maybe the guy was just "suicidial and tried to kill himself"--lol

Yeah, that's what Geico said, that the cops aren't the final word and they don't even go by their findings if they find what they consider to be opposing views. So to Geico, we're not at fault. Maybe the cop had a bad day or who knows?
