I guess it's possible, but I would say unlikely. I've sent you a couple emails about the problem, could you reply to them so I can fix this. Then I'll post what the solution was.

I dont go on this site very much, so a pm here is not very helpful. I go on the Pirate4x4 Hummer section, pm me there if you need to get a hold of me. I have also been gone for a couple of weeks in Baja supporting Team Hummer's double winning 1000 victory!!! No problems with Fox shocks there!!
If the Fox shocks are off of the H3, try to compress them, they should take some force to compress, and should extend to full extension all by themselves. I can't think of any other reason that you would get different ride height from the shocks other than a difference in nitrogen pressure in the resivor.

Hey trailer, no answer yet. Sam and I are still talking. He prolly thinks I'm crazy, and I might be, or maybe I just have bad luck. I got my shackles on last weekend and with the stock shocks, everything is even. If I find some free time (and the weather clears up) I'll swap the fox shocks back on and re-measure.

O.K. Good luck with that. If it is something with the shock I think that Sam dude will help you out. He seemed pretty cool when I got my stuff from him.... But.... Now, you have me looking at mine all the time seeing if it is sitting level in the rear.

LOL, that's funny. I can understand his position. He's probably never had a problem with them and here's someone saying they're causing his truck to sit an inch off from side to side.  The last pm with him he offered to contact Fox about the warrenty options. I'll wait until I get them on the truck again before I ask him to do that. Maybe replacing the shackles has let something sit better and the problem will go away. Who knows.
